SHIPPING, RETURNS, RIGHT OF WITHDRAWAL AND PRODUCT DEFECTS
General Information
Our website offers high-quality Italian fabrics, available in fixed lengths.
Our fabrics are divided into two main categories:
Stock Fabrics
Fabrics that are already physically available in our warehouse and ready for shipment.
Bunch Collection Fabrics
Fabrics from the collections of selected Italian and European wool mills that are not normally held in our warehouse. These fabrics are ordered from the mill after the customer’s purchase. The length offered on the website is a fixed, predefined length.
The availability status and supply method are indicated on the relevant product page.
Stock Fabrics
Stock fabrics are already available in our warehouse in the exact length stated on the product page.
The length shown on the product page is the available piece offered for sale. Standard online orders cannot be changed to a different length.
Customers are strongly advised to inspect the fabric carefully immediately after delivery and before cutting, tailoring, washing, or otherwise processing the fabric.
Bunch Collection Fabrics
Bunch Collection fabrics are not normally held in our warehouse.
When a customer places an order for a Bunch Collection fabric, we order the specified fixed-length piece from the relevant wool mill. The mill cuts the required length directly from the fabric roll specifically for our order.
Because these fabrics are sourced from the mill following the customer’s purchase, delivery times may be longer than for Stock fabrics.
The availability of Bunch Collection fabrics is subject to confirmation by the relevant manufacturer. If a fabric is unavailable, discontinued, or cannot be supplied, we will inform the customer and, where applicable, provide a refund in accordance with the applicable law.
The fact that a Bunch Collection fabric is ordered from the mill after purchase does not, by itself, remove any mandatory consumer rights that may apply under applicable law.
Right of Withdrawal
If you are a consumer purchasing online, you generally have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without having to provide a reason, subject to the exceptions provided by applicable law.
The withdrawal period begins on the day on which you, or a third party designated by you other than the carrier, receive physical possession of the goods.
To exercise the right of withdrawal, you must notify us of your decision through an explicit statement sent using the contact details provided on our website within the applicable withdrawal period.
You may use the standard withdrawal form where applicable, but you are not required to use a specific form provided that your communication clearly states your decision to withdraw.
Condition of Returned Fabrics
Where the right of withdrawal applies, the fabric must be returned in a condition suitable for resale.
The fabric must:
- remain uncut;
- remain unused;
- not have been sewn, tailored, washed, treated, or otherwise modified;
- remain in substantially the same condition in which it was received.
Customers may inspect the fabric in a manner comparable to what would reasonably be permitted in a physical fabric shop.
Please inspect the fabric carefully before cutting or processing it.
If the fabric has been handled beyond what is necessary to establish its nature, characteristics and condition, the customer may be responsible for any resulting reduction in value, to the extent permitted by applicable law.
Return Shipping Costs
Where the customer exercises the right of withdrawal, the direct cost of returning the product is the customer’s responsibility, unless applicable law provides otherwise.
The customer is responsible for ensuring that the returned fabric is properly packaged and safely shipped to us.
We recommend using a tracked delivery service and retaining proof of shipment until the return has been completed.
Refunds
Where a valid right of withdrawal has been exercised, we will issue the refund in accordance with applicable law.
The refund will normally be made using the same payment method used for the original transaction, unless otherwise agreed with the customer.
Where a customer exercises the statutory right of withdrawal in accordance with applicable consumer law, we will refund only the price paid for the fabric and not the cost of the standard delivery service originally selected by the customer.
We may withhold the refund until we have received the returned goods or until the customer provides evidence that the goods have been shipped back, whichever occurs first, as permitted by applicable law.
Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in circumstances expressly excluded by applicable law.
In particular, under Article 59 of the Italian Consumer Code, the right of withdrawal does not apply to goods that are made to the consumer’s specifications or clearly personalised, where the statutory requirements for this exception are met.
For any customised or individually specified order, we will inform the customer of the applicable conditions before the order is confirmed.
Where the right of withdrawal does not apply by law, this will be communicated to the customer before completion of the purchase.
Custom Orders
Any request for a length, cut, quantity, or other specification different from the standard products offered on our website will be treated as a separate custom order.
The applicable product specifications, price, availability, estimated delivery time, and return conditions will be communicated to the customer before the order is confirmed.
Where a product is made according to the customer’s individual specifications or is clearly personalised and therefore falls within the applicable statutory exception, the right of withdrawal will not apply.
Defective or Non-Conforming Fabrics
All fabrics should be carefully inspected immediately after delivery and before cutting, tailoring, washing, or otherwise processing the fabric.
The customer should check:
- the fabric article;
- colour and pattern;
- composition;
- quantity;
- visible defects;
- and whether the product corresponds to the order.
If the fabric is defective, damaged, or does not correspond to the product ordered, please contact us as soon as possible and, where possible, before cutting or processing the fabric.
To allow us to investigate the issue promptly, we may ask the customer to provide photographs of the fabric and the reported defect or non-conformity.
Where a product is defective or does not conform to the contract, the customer’s statutory rights and remedies under the applicable legal guarantee of conformity remain unaffected.
Nothing in this policy limits or excludes any mandatory consumer rights relating to defective or non-conforming products.
Fabrics That Have Been Cut or Processed
Customers should always inspect the fabric before cutting or processing it.
Once fabric has been cut, sewn, washed, altered, or otherwise processed, it may no longer qualify for return under the ordinary right of withdrawal where such processing has caused a reduction in value or otherwise altered the product, to the extent permitted by applicable law.
This provision does not affect the customer’s statutory rights in relation to defective or non-conforming products.
Colour Representation
We make every effort to represent the colours of our fabrics as accurately as possible in the photographs displayed on our website.
However, the appearance of colours may vary depending on the customer’s monitor, smartphone, tablet, screen settings, lighting conditions, and other factors.
For this reason, there may be minor differences between the colour displayed on screen and the actual colour of the fabric.
Normal variations caused by digital colour reproduction do not, in themselves, constitute a defect or non-conformity of the fabric.
Where samples are available, we recommend requesting a fabric sample before purchasing, particularly for delicate or difficult-to-reproduce colours.
Inspection Before Tailoring
Because our fabrics are intended for tailoring and other specialised applications, we strongly recommend that the fabric is inspected in its entirety before it is cut or used to make a garment.
Once a fabric has been cut or incorporated into a garment, any issue should be reported to us immediately.
We cannot accept responsibility for tailoring, cutting, manufacturing, or other costs incurred after the fabric has been cut or processed, except where such responsibility is required by applicable law.
Bunch Collection – Availability and Delivery
Bunch Collection fabrics are ordered from the relevant wool mill following the customer’s purchase.
The stated delivery time for these products is therefore an estimated timeframe and may depend on the manufacturer’s availability and processing time.
If the manufacturer informs us that the requested fabric cannot be supplied, we will contact the customer as soon as possible and, where applicable, provide a refund in accordance with applicable law.
Applicable Consumer Rights
Nothing in this policy is intended to restrict or exclude any rights granted to consumers by mandatory provisions of applicable Italian or European law.
Where any provision of this policy conflicts with a mandatory legal provision, the applicable legal provision will prevail.
